The criminal and civil consequences of driving with a blood alcohol concentration (BAC) of .08 or higher are severe and could impact your ability to drive legally. However, there are other criminal charges and various factors that are equally severe.

Zero tolerance — Any BAC of a driver under 21 will result in serious penalties. The slightest trace of alcohol on an adult or child under that age can result in the loss of a license for two years. Not only does a conviction affect the ability to work or attend school, but any background checks will show a criminal record.

Prescription drug-related DUI — A "per se DUI" is charged when prescription medication affects the ability to drive. Common drugs that have led to an arrest include Vicodin, Percocet, Soma, Ambien and OxyContin. Residue of the drug showing up in your bloodstream can result in the same consequences as a DUI involving alcohol.

DUI with medicinal marijuana — Driving under the influence of drugs (DUID), including medical marijuana is a zero tolerance crime. Any trace of cannabis leads to a mandatory prison sentence of 48 hours following the arrest and up to six months of incarceration if convicted.

Nondriving DUI — Control of the vehicle is a key component of a DUI criminal charge. The decision to not drive because of too much drinking and sleeping in the car can still lead to an arrest. Simply put, if the keys are available to the impaired driver, he or she will face serious charges.
