What Is Assault & Battery?

Utah law defines assault and battery as an attempt or act, with unlawful force or violence, to cause bodily injury to another or create a substantial risk of bodily injury to another. The difference between assault and battery is that assault is the threat or intention of causing physical harm while battery refers to the actual act causing physical harm.

Assault is a class B misdemeanor that can be enhanced to a class A misdemeanor if the person causes substantial bodily injury to another or the victim is pregnant, and the person has knowledge of the pregnancy. If convicted of a class B misdemeanor, you may be punished with up to 6 months in jail and/or up to $1,000 fines or compensatory service. If convicted of a class A misdemeanor, you may be looking at up to 364 days in jail and/or up to $2,500 fines.

Sometimes an assault charge is combined with other types of criminal charges or legal issues. For example, if you are accused of domestic violence or domestic assault, you may also have a restraining order filed against you.
